Criminal Defense

What is Criminal Defense?

Criminal Defense is legal defense for someone who has been accused of a crime. Unlike in Civil Litigation, where one party claims to have been wronged by another, Criminal Defense deals with alleged offenses against the public or the state. The punishment for a criminal conviction is assigned by a judge and is usually determined by the seriousness of the crime.

In Lycoming County, crimes are categorized as either felonies or misdemeanors. Felonies are the more serious crimes carrying severe penalties. Misdemeanors are considered less serious and carry lighter potential sentences.

Do I Need a Defense Attorney?

This depends on the seriousness of the crime charged. An attorney can help you understand your rights even during the investigative stage before charges are filed. If the police suspect a felony has been committed, they often obtain an arrest warrant. An attorney may — although not always — be able to arrange for a client to submit himself or herself to authorities at a designated time and place rather than having the police make the arrest at home or work. If you are being investigated for a felony, consider hiring an attorney promptly.

Regardless of the level of your offense, don’t wait until after the preliminary hearing to hire an attorney. Give your attorney time to familiarize himself or herself with your case before the preliminary hearing.

We at Fetter McDermott would be happy to provide you with an initial consultation, free of charge, to help you decide whether and when to hire an attorney. Call us today to schedule your free consulation.

DUI Representation

What happens after I’ve been arrested for Driving Under the Influence?

Driving Under the Influence (DUI), sometimes known as Drunk Driving or Driving While Intoxicated (DWI), is one of the most common crimes committed in Williamsport and Lycoming County. Often, people charged with this crime are facing the court system for the first time. If you have no prior criminal record, there is a very good chance that you could qualify for the “ARD” program — Accelerated Rehabilitative Disposition. ARD is a special probation program requiring the defendant to pay fines, attend special programs, and perform community service. If the program is completed successfully, most likely no conviction will be entered on your record.

How can Fetter McDermott help me with my DUI charges?

Individuals charged with DUI are entitled to legal representation, just like defendants of any criminal charge. Fetter McDermott will ensure that you receive the best possible defense and that your rights are protected throughout all legal proceedings.

If it should happen that you are convicted of DUI charges, Fetter McDermott will advocate on your behalf for a fair sentence. If it is your first DUI offense, our attorneys may be able to get you into the ARD program with a chance to avoid a conviction on your record.
